Sublease Agreement
This agreement is made on 7 November 2026 between:
- Maria Costa, of Rua das Flores 45, 4050 Porto, Portugal ("the Tenant"); and
- Daniel Okafor, whose contact details are daniel.okafor@example.com, +351 912 345 678 ("the Subtenant").
The Tenant rents the property below from Alves Property Ltd ("the Landlord") and wishes to let the second bedroom, with shared use of the kitchen, bathroom and living room to the Subtenant. They agree as follows.
1. The property and the part sublet
1.1 The property is at Flat 4, 22 Elm Street, Bristol BS1 4AB (the "Property").
1.2 The Tenant lets to the Subtenant the second bedroom, with shared use of the kitchen, bathroom and living room (the "Premises"), together with the right to use the shared parts of the Property in the normal way.
1.3 The Tenant holds the Property from the Landlord under a lease dated 1 September 2025, which ends on 31 August 2027 (the "Head Lease"). The Subtenant has been given a copy, or has read it, and agrees to keep to its terms as they affect the Premises and the Property.
1.4 Other people who live in the Property: The Tenant and one other housemate
2. The Landlord's consent
2.1 The Tenant confirms that the Landlord has agreed in writing to this sublease. The Landlord's consent is given by signing at the end of this agreement or by a separate letter that is attached.
2.2 The subtenant must keep to the head lease and may not sublet further.
2.3 This agreement does not start until the Landlord's consent has been given. If the Landlord refuses or withdraws consent, this agreement ends, the Tenant will repay everything the Subtenant has paid, and neither party owes the other anything else.
2.4 The Subtenant may not sublet or share the Premises with anyone else, or let anyone other than those named in this agreement live there.
3. Term
3.1 The sublease starts on 1 February 2027 and ends on 31 July 2027, unless it ends sooner under this agreement.
3.2 The sublease cannot run beyond the Head Lease. If the Head Lease ends earlier, section 9 applies.
3.3 If the Subtenant stays after the end date with the Tenant's agreement, the sublease continues month to month on the same terms, and either party may end it on 30 days' written notice, but never beyond the end of the Head Lease.
4. Rent
4.1 The Subtenant will pay the Tenant rent of GBP 650 a month, due on the first day of each month, by bank transfer to the Tenant's account ending 4821.
4.2 The rent for a part of a month is charged by the day. The rent does not change during the term, except by a written agreement signed by both parties.
4.3 The Subtenant may not hold back or reduce the rent because of a claim against the Tenant, except as the law allows.
4.4 The rent will not be more than the share of the rent under the Head Lease and the bills that the Premises fairly bear, unless the law allows more. The Tenant will show the Subtenant what the Landlord charges on request.
4.5 A rent payment that is more than 7 days late is a breach of this agreement. The Tenant will remind the Subtenant in writing and the Subtenant will pay within 7 days of the reminder.
5. Deposit
5.1 The Subtenant will pay the Tenant a deposit of GBP 650 before the start date, as security for the rent and for loss or damage that the Subtenant causes. The deposit is not rent and is not a limit on what the Subtenant may owe.
5.2 The Tenant will hold the deposit in the Tenant's separate savings account, and will not use it for anything else. Where the law requires the deposit to be protected in a scheme or kept in a special way, the Tenant will do so and tell the Subtenant how.
5.3 Within 14 days after the sublease ends and the Subtenant has left, the Tenant will return the deposit, less fair deductions for unpaid rent and bills, for damage beyond fair wear and tear, and for cleaning that is needed to bring the Premises back to the state recorded in the inventory. The Tenant will give the Subtenant a written list of the deductions with the reasons and the proof.
6. Bills
6.1 The bills for the Property are paid as follows. Electricity, gas and internet are shared equally by the people living in the property. Water is included in the rent.
6.2 The Subtenant will pay a bill within 7 days of getting a copy and will pay for any use that is over what is normal for one person, if a meter shows it.
6.3 The Tenant will not charge more than the real cost of a bill, and will show the Subtenant the bills on request. The Subtenant is responsible for any council or local tax that the law places on the person who lives in the Premises, if there is one.
7. Use and house rules
7.1 The Subtenant will use the Premises only as a home for the people named in this agreement, will not run a business there, and will keep them clean, tidy and safe.
7.2 The Subtenant will not do anything that breaks the Head Lease, the law or the rules of the building, or that causes a nuisance, danger, noise or annoyance to the Landlord, to the neighbours or to other people in the Property. The Subtenant will not change, decorate or fix anything to the Premises without the Tenant's written permission and, where the Head Lease needs it, the Landlord's.
7.3 No pets are allowed.
7.4 The Subtenant will keep the following house rules, and any reasonable rule that the Tenant adds in writing after telling the Subtenant and giving a fair time to read it.
No smoking indoors
Quiet after 22:00
No overnight guests for more than three nights in a row without asking
7.5 The Subtenant will keep the Premises locked when it is empty, will keep the keys safe and will not copy them. If a key is lost, the Subtenant will tell the Tenant at once and pay the reasonable cost of changing the lock.
8. Repairs, care and access
8.1 The Subtenant will take reasonable care of the Premises and of the Property, will tell the Tenant promptly of any damage or fault that needs repair, and will pay for damage that the Subtenant or a person it lets in causes, other than fair wear and tear.
8.2 The Tenant will pass on the Subtenant's repair requests to the Landlord quickly and follow them up, and will keep the Property in the condition that the Head Lease requires, so far as the Tenant is able to. The Tenant is not liable for the Landlord's delay in making a repair that is the Landlord's duty, but will do what it can to speed it up.
8.3 The Subtenant may pay for a small repair that cannot wait, up to GBP 50, and send the Tenant the receipt, and the Tenant will refund it or take it off the next rent.
8.4 The Tenant and the Landlord, and people they send, may enter the Premises at a reasonable time on at least 24 hours' notice to inspect it, to carry out repairs or to show it to others. In an emergency they may enter at once.
9. If the Head Lease ends
9.1 The Subtenant understands that the sublease depends on the Head Lease. If the Head Lease ends before the end date of the sublease, for any reason, the sublease ends with it.
9.2 The Tenant will not end the Head Lease early, or agree to it being ended, or do or fail to do anything that gives the Landlord a right to end it, while this sublease runs, without the Subtenant's written agreement. The Tenant will tell the Subtenant at once if the Landlord gives any notice about the Head Lease or the Property.
9.3 If the Head Lease ends because of something the Tenant did or did not do, the Tenant will pay the Subtenant's reasonable moving costs and will repay the rent for the time after the end, together with the deposit.
9.4 If it ends through no fault of the Tenant, the Tenant will repay the rent paid for the time after the end and the deposit, and will give the Subtenant as much notice of the end as it can. If the law gives the Subtenant a greater right, that right applies.
10. Ending the sublease
10.1 The Subtenant may end the sublease before the end date by giving the Tenant at least 30 days' written notice. The Tenant may end it early by giving at least the same notice, but only for a serious breach by the Subtenant that has not been put right, or for a reason that the law allows.
10.2 If the Subtenant stops living in the Premises early, the rent is due until the end of the notice period, or until a new subtenant that the Tenant has accepted, who is approved by the Landlord, moves in, if earlier.
10.3 The Tenant may end this sublease at once by written notice if the Subtenant seriously breaks this agreement, for example by not paying rent after a reminder, by damaging the Premises or by causing serious nuisance, and the breach is not put right within 7 days of a written notice, or cannot be put right. This does not take away any right of the Subtenant under the law, and the Tenant will use the process that the law requires to recover the Premises.
10.4 On the last day the Subtenant will leave the Premises clean, empty of its own things and in the state in the inventory, except for fair wear and tear, return all keys and give the Tenant a forwarding address.
11. Inventory
11.1 The Premises come with the following furniture and items.
Double bed and mattress, wardrobe, desk and chair, two lamps, shared washing machine
11.2 The Tenant and the Subtenant will walk through the Premises on the start date and note in writing, or by photographs, the state of the Premises and of the items. Both will sign or confirm the record, and it will show the state at the start. If the Subtenant does not report a fault within 7 days of the start date, the record of the Tenant is taken to be correct, unless the fault could not be seen.
11.3 The Subtenant will give the items back in the same state, except for fair wear and tear, or pay their reasonable cost.
12. Insurance
The Subtenant is responsible for insuring its own belongings, and the Tenant and the Landlord are not liable for loss of or damage to them, except where the law holds them responsible. The Subtenant will not do anything that would make the insurance of the Property void or more expensive.
13. Law and disputes
This agreement, and any dispute that arises from it, is governed by the laws of England and Wales. The parties will first try to settle any dispute by discussing it in good faith for 14 days after one of them gives written notice of it.
The place for deciding any dispute under this agreement is Bristol. How disputes are decided
Nothing in this agreement takes away a right that the law gives a subtenant and that cannot be given up.
14. General
- This agreement is the whole agreement of the parties on its subject. A change to it must be in writing and signed by both parties and, where the Head Lease needs it, agreed by the Landlord.
- If a part of this agreement is found invalid, the rest stays in force.
- Notices must be in writing and sent to the Premises, or to the email address that a party names for the purpose.
- This agreement may be signed in separate copies and electronically, and together they form one agreement.
