1. The activity
The Participant wishes to take part in the following activity (the "Activity"), which takes place on 14 December 2026 at Queenstown Bike Park and the surrounding trails:
A guided half-day mountain biking trip on the Queenstown trails, including the transport to and from the trailhead and the use of the Organiser's bikes and helmets.

2. Risks the Participant understands
The Participant understands that the Activity is physical and carries risks, some of which can be serious. They include:
falls, collisions with other riders, rocks, tree roots and wildlife, mechanical failure of the bike, changes in the weather, exhaustion and dehydration
These and other risks, including ones nobody expects, may cause injury, illness, disability, death, or loss of or damage to property. The Organiser takes reasonable care to reduce them, but they cannot be removed completely, even if everyone takes care.
3. Taking the risk
The Participant takes part in the Activity freely and by choice, and accepts the risks described in section 2, including ones caused by the carelessness of other participants. The Participant will follow all instructions, safety rules and warnings from the Organiser and its staff, will use the equipment properly, will tell the Organiser at once if they feel unwell, unfit or unsafe, and will not take part under the influence of alcohol or drugs. The Organiser may stop the Participant from taking part, without refund, if the Organiser believes it is unsafe for them or for others.
4. Release
To the fullest extent the law allows, the Participant releases the Organiser, its owners, directors, employees, volunteers, instructors and agents, and the owners of the place where the Activity takes place, from every claim for injury, illness, death, or loss of or damage to property, that arises from the Participant's taking part in the Activity, including claims arising from the ordinary negligence of the people released. The Participant promises not to bring such a claim.
5. Not covered by this release
This waiver does not release a claim for death or personal injury caused by gross negligence or by wilful or reckless acts of the Organiser or its staff, for fraud, or for any other liability that the law does not allow to be released.
6. Looking after the Organiser
The Participant will compensate the Organiser, and the other people released in section 4, for the costs, losses and claims that arise because the Participant broke the rules of the Activity, acted recklessly, or caused harm to another person or to property, including reasonable legal fees. This does not apply to a claim that section 5 excludes.

8. Medical help and emergency contact
The Participant agrees that, if they are injured or become ill, the Organiser and its staff may arrange first aid and call for medical help, ambulance and transport, and may pass on to the medical staff the information the Participant gives in this form. The Participant will pay the cost of medical treatment and transport that follows, unless the law or an insurer says otherwise.
In an emergency, the Organiser may call: Claire Moreau (sister), +33 6 12 34 56 78.
The Participant has told the Organiser the following about their health: Asthma, with an inhaler carried in a jacket pocket. Allergic to penicillin.
The Participant confirms that, apart from anything stated in this form, they have no medical condition, injury or medication that makes the Activity unsafe for them. The Organiser will keep this information private and use it only for the Participant's safety.
9. Equipment and conduct
The Participant will check any equipment the Organiser supplies before use and will not use it if they think it is unsafe or does not fit them. The Participant will take care of the equipment and will repay the Organiser for loss or damage that they cause by misuse or carelessness. The Participant will treat the other participants, the Organiser's staff, the place and its wildlife and neighbours with respect, will keep to the law, and will not bring anyone or anything onto the Activity that the Organiser has not approved.
10. Photographs
The Participant allows the Organiser to take photographs and recordings of the Activity, and to use them to describe and promote its work, unless the Participant tells the Organiser in writing before the Activity that they do not agree.
11. Participants under 18
If the Participant is under 18, the parent or guardian who signs below confirms that they have legal authority for the Participant. They have read this waiver, they explain it to the Participant, they agree to it for the Participant and for themselves, they give the consent for medical help in section 8, and they will be bound by sections 4 and 6 to the extent the law allows.
12. Weather and changes
The Organiser may change, shorten, move or cancel the Activity because of weather, safety, the condition of the place or any other reason beyond its control. The Organiser will offer a refund or another date for an Activity it cancels. It does not have to refund a Participant who chooses not to take part, or who is stopped under section 3, unless the law says so.
13. General
- The Participant has read this waiver, has had the chance to ask questions, understands that it gives up legal rights, and signs it freely.
- If any part of this waiver cannot be enforced, the rest stays in effect, and the part that cannot be enforced is to be applied as far as the law allows.
- This waiver stays in effect for the whole Activity, including any later session of it, unless the Participant withdraws it in writing before that session.
- This waiver is governed by the laws of New Zealand.
