TidyPlan terms of use

Last updated: 1 November 2028

1. Who we are and what these terms cover

1.1 These terms are between you and Brightwater Apps Ltd of 20 Mill Lane, Bristol BS1 4DJ, United Kingdom ("we", "us", "our").

Registered in England and Wales, company number 09876543

1.2 They apply to TidyPlan ("the app"), including its software, content, updates and any related website or support, on iPhone, Android and the web at tidyplan.example. In short, the app does this:

TidyPlan helps households plan chores and share shopping lists.

1.3 You can contact us at support@tidyplan.example.

2. Accepting these terms

2.1 By creating an account, or by installing, opening or using the app, you agree to these terms and to our privacy policy. If you do not agree, do not use the app.

2.2 If you use the app for a business or for another person or organisation, you confirm you have the authority to bind it to these terms, and "you" includes it.

2.3 Where you got the app from an app store, the store's own terms also apply between you and the store. If they conflict with these terms about the store's service, the store's terms apply to that service.

3. Who can use the app

3.1 You must be at least 16 years old to use the app. If you are younger than the age at which you can agree to these terms where you live, you may use the app only with the agreement of a parent or guardian, where the law allows that.

3.2 You must not use the app if we have closed your account for breaking these terms, or if the law forbids you from using it.

4. Your account and security

4.1 You give us true, complete and current details when you create an account, and you keep them up to date.

4.2 You keep your password and any other sign-in details safe, and you do not share them. You are responsible for what happens under your account unless it is our fault.

4.3 Tell us at support@tidyplan.example at once if you think someone else has used your account or your details. We may ask you to change your password or to prove who you are.

4.4 You may have one account only, unless we say you may have more.

5. Licence to use the app

5.1 We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own use, under these terms. You may not sub-license it.

5.2 The app, its design, text, graphics, trade marks and code belong to us or our licensors, and are protected by law. We keep all rights that these terms do not give you.

5.3 You may not copy, change, translate, reverse engineer, decompile or try to get the source code of the app, or build another product from it, except where the law lets you do so despite this term. You may not remove any notice of ownership from it. If the app includes open-source software, that software is under its own licence, which applies instead of this section for that software.

6. Acceptable use

You will not use the app to, or let anyone else:

  • break the law, or others' rights, including their intellectual property and privacy;
  • harm, harass, threaten, deceive or impersonate anyone, or publish hateful, abusive, sexually explicit or violent content, or content that exploits children;
  • send spam, malware or anything else that is harmful or unsolicited;
  • try to get into accounts, systems or data that are not yours, or test or probe the app's security without our written permission;
  • disrupt, overload or damage the app or the systems that run it;
  • use bots, scrapers or other automated means to get data from the app, or use it to train a machine learning model, without our written permission;
  • sell, rent, lend or share access to the app, or use it to build a competing product;
  • go around any limit, payment or security feature of the app.

7. Your content

7.1 "Your content" means what you create, upload or share in the app.

Lists, notes and photos shared with the household.

7.2 You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and show it, as needed to run, protect and improve the app and to provide it to you and to the people you choose to share it with. The licence lasts while your content is in the app, and for a reasonable time after you delete it while it is removed from backups.

7.3 You confirm that you have all the rights needed to give us this licence, and that your content, and our use of it as these terms allow, does not break the law or anyone's rights.

7.4 We do not check your content before it appears, and we are not responsible for it. We may remove or hide content, or limit who can see it, if we reasonably think it breaks these terms or the law, or if someone makes a valid complaint about it. Where we can, we will tell you why.

7.5 If you think content in the app infringes your rights, write to support@tidyplan.example with a description of the content, where to find it, and why you think it is unlawful, and we will look at it promptly.

8. Paid features, purchases and refunds

8.1 Is anything paid? If some features are paid, this section applies to them.

8.2 Prices are shown in the app or in the store before you buy, and include tax where the law requires it. The store you buy from takes the payment, under its own terms. We may change prices, but a change does not affect a subscription period you have already paid for.

8.3 Purchases and subscriptions bought in an app store are billed, cancelled and refunded through that store. Refunds follow the store's rules. Where we can decide, we will refund a payment where the law requires it, for example where the app does not work as it should and we cannot put that right, or where you have a legal right to cancel and have used it in time.

8.4 Plus costs 3.99 a month, renews each month until cancelled in your store account. Refunds follow the store's rules and your legal rights.

8.5 New subscribers get a 7-day free trial, and the first payment is taken when the trial ends unless the subscription is cancelled before then.

8.6 If you pay by subscription, the subscription renews automatically for the same period, at the price then shown to you, until you cancel it. You cancel it in your store account or in the account settings of the app, before the end of the current period. Cancelling stops future renewals, and you keep the paid features until the end of the period you have paid for, without a refund for part of that period unless the law or the store's rules give you one. We will tell you in good time, as the law requires, before the price of a subscription changes.

8.7 If you are a consumer, you may have a legal right to cancel a digital purchase within a fixed time. If you ask for the digital content to start at once, you may lose that right when it has started, as the law allows. This section does not take away any right that the law gives you.

9. Updates and changes to the app

9.1 We may update the app to fix errors, improve it, keep it secure, or follow the law, and we may add, change or remove features. You may need to install an update to keep using the app.

9.2 If we make a change that significantly reduces what you have paid for, we will tell you beforehand, and you can end your paid plan and, where the law gives you the right, receive a refund for the part of the period you can no longer use.

9.3 We try to keep the app running, but it may be unavailable at times for maintenance, repair or reasons outside our control.

10. Third-party services

10.1 The app may link to, use or work with services from other companies, such as your device, the app store, payment providers, and sign-in or map services.

Maps are provided by OpenStreetMap contributors, and sign-in by Apple or Google if you choose it.

10.2 These services are not under our control and have their own terms and privacy policies. We are not responsible for them, and you use them at your own risk. If a third-party service stops or changes, the part of the app that depends on it may stop or change.

11. Privacy

How we collect and use personal data is explained in our privacy policy at https://tidyplan.example/privacy. It is not part of these terms, but you should read it.

12. Suspension and ending

12.1 You can stop using the app and delete your account at any time, in the app or by writing to support@tidyplan.example. Deleting your account does not by itself cancel a subscription bought through a store; you must cancel that in the store.

12.2 We may suspend or close your account, or limit your access to part of the app, if you break these terms or the law, if you do not pay what you owe, if we reasonably think your account is being used to harm others or the app, or if the law requires us to. We will tell you why and give you a chance to put things right where this is reasonable. We may stop providing the app altogether, and will then give you reasonable notice and refund any payment for the period after the app stops.

12.3 When your account ends, your right to use the app ends. We will delete your account data as our privacy policy explains, and you may ask us to export your content before that where the law gives you that right.

12.4 Sections that by their nature continue, such as sections 5.2, 7, 13, 14 and 16, continue after these terms end.

13. Disclaimers

13.1 The app is provided "as it is" and "as available". As far as the law allows, we do not promise that the app will be free of errors, interruptions or harmful components, that it will meet your particular needs, or that it will always be available or secure, or that its content is accurate or complete.

13.2 The app is a general tool. It is not professional advice of any kind, and you should not rely on it as a substitute for professional advice.

13.3 These disclaimers do not apply where the law does not allow them, and they do not affect the rights that consumer law gives you, including that digital content must be as described, of satisfactory quality and fit for its purpose, and that you may have remedies if it is not.

14. Our responsibility to you

14.1 Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

14.2 If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable. We are also not responsible for loss that is caused by your breaking these terms, or by events outside our reasonable control.

14.3 If you use the app for a business, we are not responsible for loss of profit, revenue, business, data or goodwill, or for indirect loss, and as far as the law allows, our total responsibility to you for all claims arising from the app is limited to what you paid us in the 12 months before the first event that caused the claim.

14.4 You are responsible to us for loss we suffer because you break these terms, and you will pay our reasonable costs of any claim that others make against us because of your content or your breach, as far as the law allows.

15. Changes to these terms

15.1 We may change these terms, for example to reflect changes in the app, in the law or in our business. We will tell you in the app or by email before an important change starts, at least 30 days beforehand where we can, and the date at the top of these terms will change.

15.2 If you keep using the app after a change starts, you accept the new terms. If you do not accept them, you can stop using the app and delete your account, and where you have paid in advance for a period after that you may ask for a refund of the part you cannot use as section 9.2 explains.

16. General

  • These terms, with the privacy policy, are the whole agreement between you and us about the app, and replace earlier ones.
  • You may not transfer your rights or duties under these terms. We may transfer ours to another company that takes over the app, and will tell you.
  • If a part of these terms is found invalid, the rest stays in force.
  • If we do not use a right at once, we have not given it up.
  • No one else has the right to enforce these terms, except our group companies and licensors, who may protect their rights in the app.
  • We may send you notices by email, or in the app, and you may send us notices at the address in section 17.
  • These terms and any dispute about them or the app are governed by the law of England and Wales. The courts of that place can decide any dispute, except that if you are a consumer you also keep the protection of the mandatory rules of the country where you live, and may bring a claim in the courts there and be sued only there.
  • If you have a complaint, write to us first at support@tidyplan.example, and we will try to settle it promptly and fairly.

Policies and terms

Questions people ask

What details does this template ask for?

The form asks for 16 details, starting with Company that runs the app, Company's address, App name, What the app does, Where it is available. 5 more are optional.

Can I download this template as Word or PDF?

Yes. When you have filled in the form, save it as a Word document to keep editing, or as a PDF to send or print. It is free and needs no account.

Is what I type sent anywhere?

No. What you type stays in your browser while you fill in the document. It only goes to nerix if you choose to open the template in the chat.

What should I check before I use this template?

Consumer, data protection, age and payment rules differ by country, and some countries do not allow limits on liability or automatic renewal terms. App stores add their own terms, and these terms must not take away the rights that consumer law gives your users. Check them for the places your users live, have a lawyer review the final text, and keep your privacy policy consistent with it. This is not legal advice.

Are these policy templates free?

Most are. Fill in and download them for free, with no account. A few longer policies are premium: free to fill in, paid once to download, and marked with their price.

Does a privacy notice make my website compliant?

No document alone does. A notice must match what your site really does with data, and the law depends on where your visitors are. Use the template as a base and check the rules that apply to you.

Where should I publish a policy?

Put it on its own page and link to it from your footer and from the checkout, so customers can find it before they pay.

How often should I update a policy?

Whenever your practice changes, and at least once a year. Put the date on the page so people know which version applies.
