Place: Dublin, Ireland
1. The parties
The principal: Aisha Karimi
42 Willow Road, Dublin, D06 AB34, Ireland
Passport P1234567
The attorney: Omar Karimi
7 Harbour View, Cork, T12 CD56, Ireland
Passport P7654321
2. The power
2.1 I, Aisha Karimi, appoint Omar Karimi as my attorney to act for me, in my name, on the matters in section 3. This is: Specific matters only.
2.2 If this is a power over specific matters only, the attorney may act only on the matters listed in section 3. If this is a general power, the attorney may do for me anything I could lawfully do myself, in addition to the matters listed, except what section 4 excludes.
2.3 Can the attorney appoint someone else to act
3. What the attorney may do
Sign the sale contract for the flat at 42 Willow Road
Receive the sale money into my account at Example Bank
Sign tax and land registry forms for the sale
In doing these things the attorney may sign, deliver and receive documents, make and receive payments, deal with banks, public offices and other persons, and do whatever is reasonably needed to carry them out.
3.1 Powers over money and property, where listed above, include the power to open, use and close accounts in my name, to receive money owed to me, to pay my debts and bills, to sign receipts, and to keep my money safe, but only to the extent that they are named in the list above.
3.2 Powers over land and buildings, where listed above, include the power to sign a sale, purchase or lease, to give and receive possession, and to sign the forms that a land registry or tax office needs, but only for the property named in the list above.
3.3 The attorney may use a copy of this document, including an electronic copy, where the person dealing with the attorney accepts it. The attorney will show the original when a person reasonably asks for it.
4. Limits
The sale price must not be below EUR 280,000. The attorney may not borrow money in my name.
The attorney may not do anything not listed above, unless this is a general power. In every case, unless the law of the place named in section 10 allows it and I say so in section 3 or in the limits above, the attorney may not:
- make a will, or change or revoke one, for me;
- make a gift of my property, except small customary gifts;
- marry, divorce, adopt or consent to medical treatment for me, or take decisions about my children;
- take a vote, make an oath or give evidence for me where the law requires me to do it in person; or
- sign anything for the attorney's own benefit, or for a person with whom the attorney has a conflict of interest, unless I have clearly said so above.
5. Start and end
5.1 The power starts on 1 December 2027.
5.2 It ends on 31 March 2028.
5.3 If I can no longer make decisions for myself: The power ends. Where the law requires special words, steps, registration or a medical certificate for a power to continue, the power continues only if those are met.
5.4 The power also ends when I die, when the attorney dies or can no longer act (unless a replacement attorney is named in section 8), when the matters in section 3 are finished, or when a court or the law ends it.
6. Cancelling the power
6.1 I may cancel this power at any time by telling the attorney in writing. A cancellation takes effect against another person from the time that person learns of it, so I will also tell any bank, office or other person I know of who relies on this power, and take back the original document.
6.2 The attorney may resign by giving me written notice, and will first complete any urgent matter so that I do not suffer loss.
7. Duties of the attorney
7.1 The attorney will act honestly, with reasonable care and in my interest, and within the law and the limits of this document.
7.2 The attorney will keep my money and property apart from the attorney's own, and will not use them for the attorney's own benefit.
7.3 The attorney will keep records of everything done under this power, including money received and paid, and will show them to me, or to a person I name, when asked. After the power ends, the attorney will give me, or my heirs, an account of what was done and hand back my property and documents.
7.4 The attorney acts without pay, and is repaid reasonable expenses with receipts.
7.5 The attorney will tell me promptly of any important decision, of anything that goes wrong, and of any dispute or claim that arises from the use of this power. If the attorney thinks that I do not have the capacity to understand what is happening, the attorney will take only the steps that cannot wait and will inform my family or the authority the law names.
7.6 The attorney will not use this power to benefit the attorney or the attorney's family, to pay the attorney, or to lend money to the attorney, except as I say in this document or as the law allows. If a conflict of interest arises, the attorney will tell me, or a court or authority where the law requires it, before acting.
8. Replacement attorney
Yusuf Karimi, of 11 Elm Park, Galway, H91 EF78, Ireland is appointed as my replacement attorney, and takes over with all the powers and limits of this document if the attorney dies, resigns or cannot act.
9. Reliance by other persons
9.1 A person who deals with the attorney under this power may rely on it, and on a copy of it that is certified as true, unless that person knows that I have cancelled it, that it has ended, or that the attorney is acting outside it.
9.2 I agree that I am bound by what the attorney does within this power, and I will not hold a person liable who relies on it in good faith.
9.3 I will keep the attorney free of loss, other than loss caused by the attorney's dishonesty or serious carelessness, for things properly done under this power, to the extent the law allows. A person may ask the attorney for proof of identity and proof of this document, and the attorney will give it.
9.4 Where this document is to be used in another place, I agree that it may be translated, certified, apostilled or legalised, and that the attorney may sign any document for that purpose.
10. Law
This document is governed by the law of Ireland. If a rule of the place where the attorney acts requires a form, a language, a translation, a seal, a notary or registration for this document to be accepted there, the attorney may arrange it, at my cost, and I will sign what is needed.
11. Acceptance
The attorney accepts this appointment, understands the duties in section 7 and agrees to act under the limits of this document.
